About Us

This privacy policy ("Privacy Policy") explains how we process and protect your personal data when you use this Website or our services provided via www.larkventures.de (together, the "Website").

The Website is operated by LARK Ventures GmbH, Kleine Johannisstraße 6, 20457 Hamburg (the "COMPANY", "we", "our", or "us"). The Company is the controller for the data processing described below.

Unless otherwise defined in this Privacy Policy, the definitions used have the same meaning as in the EU General Data Protection Regulation.

(1) Personal data we collect

We may collect or receive personal information for a number of purposes connected with our business operations when you use our website or our services. This may include the following:

(2) How we collect personal data

We collect information about our users when they use our Website or our services, including taking certain actions within it.

Directly

Indirectly

(3) Legal basis and purposes

Our legal basis for collecting and using the personal data described in this Privacy Policy depends on the personal data we collect and the specific purposes for which we collect it.

Contract

To perform our contractual obligations or take steps linked to a contract with you — in particular to provide our services and to recruit you.

Consent

We may rely on your freely given consent at the time you provided your personal data — in particular to provide users with news, special offers, newsletters, and general information, and to use Cookies and similar technologies as described in this policy.

Legitimate interests

We may rely on legitimate interests based on our assessment that the processing is fair and reasonable — in particular to maintain and improve our Website and services, and to develop new services.

Necessity for compliance with legal obligations

To meet regulatory and public interest obligations, comply with applicable regulations and legislation, and for the legal enforcement of claims and rights.

(3.1) Newsletter

We may send newsletters and other notifications by email and through other communication channels. In principle, you must expressly consent to the use of your contact details, unless the use is permitted for other legal reasons.

Newsletters may contain web links or tracking pixels that record whether a newsletter has been opened and which links were clicked. You can unsubscribe at any time by contacting us directly or following the unsubscribe link in the footer of each newsletter.

(4) Service Providers

The Company may engage third party companies ("Service Providers") to facilitate the operation of our Website or perform Website-related services. These third parties have access to personal data only to the extent necessary to perform these tasks. Types of service providers who might access your personal data include:

(5) Data transfers

We may use service providers partly located in third countries (outside the EU or EEA) whose level of data protection may not correspond to that of the EU. We safeguard your personal data per our contractual obligations and applicable data protection legislation. Such safeguards may include adequacy decisions by the European Commission, standard data protection model clauses, or binding corporate rules.

If a third country transfer takes place without adequate safeguards, there is a risk that authorities in that country may gain access to the transferred data and that the enforceability of your data subject rights cannot be guaranteed.

(6) Data disclosure

We may disclose your personal data in the good faith belief that such action is necessary:

(7) Data Security

We take reasonable technical and organisational security measures to protect your stored data against manipulation, loss, or unauthorised third-party access. Our security measures are continually adapted to technological developments.

Our employees and Service Providers are required to maintain secrecy and comply with applicable data protection legislation. No method of transmission over the Internet is 100% secure — we recommend using antivirus software, a firewall, and other similar software to safeguard your system.

(8) Your rights

To exercise these rights, contact us at hello@larkventures.de. We may ask you to verify your identity before responding.

(9) Links to third-party apps and sites

Our website may contain links to websites not operated by us. We have no control over, and assume no responsibility for, the content or privacy practices of any third party websites. We maintain an online presence on LinkedIn to communicate with customers and provide information about our services. Content communication via LinkedIn is subject to their responsibility and privacy policy.

(10) Cookies

This website uses cookies and similar technologies provided either by us or by third parties. A cookie is a small text file stored on your device by the browser. Most browsers accept cookies by default, but you can adjust your settings to reject them — though this may affect some of our services.

(10.1) Legal basis

We use cookies only on the basis of your consent in accordance with § 25(1) TTDSG.

(10.2) Obtaining your consent

Our website uses a consent banner to collect and manage consent. When you make a decision, a cookie is set recording your choice. If you delete your cookies, we will ask for consent again on your next visit.

(10.3) Withdrawing your consent

You can revoke your consent at any time via the settings banner or by writing to hello@larkventures.de.

(10.4) Contact forms – Web3Forms

Our website uses the form submission service Web3Forms, provided by Web3Forms (webmaster@web3forms.com), to process enquiries submitted via our contact forms. When you submit a form, the data you enter (e.g. name, email address, and message) as well as technical metadata (e.g. your IP address, browser type, and the time of submission) are transmitted to and processed on servers operated by Web3Forms. Web3Forms acts as a processor on our behalf pursuant to Art. 28 GDPR. We have concluded the requisite data processing agreement with Web3Forms.

The data are processed for the sole purpose of receiving and handling your enquiry. The legal basis is Art. 6(1)(b) GDPR (performance of pre-contractual measures) and/or Art. 6(1)(f) GDPR (our legitimate interest in operating a functional contact channel). Data are not used for advertising purposes by Web3Forms and are not sold to third parties. For further information, please refer to the Web3Forms Privacy Policy.

(10.5) CAPTCHA – hCaptcha

Our contact forms are protected against automated abuse by hCaptcha, a service provided by Intuition Machines, Inc., 2211 Selig Dr, Los Angeles, CA 90026, USA ("IMI"). hCaptcha analyses user interactions (e.g. mouse movements, keystrokes, and click patterns) and, where necessary, presents interactive challenges in order to distinguish human users from automated bots. For this purpose, hCaptcha may set cookies and process data including your IP address, browser and device information, referrer URL, mouse and keyboard behaviour, date and language settings, and JavaScript objects.

Data may be transferred to servers in the United States. IMI participates in the EU–U.S. Data Privacy Framework; the transfer is therefore based on an adequacy decision of the European Commission pursuant to Art. 45 GDPR. Additionally, standard contractual clauses pursuant to Art. 46(2)(c) GDPR serve as a supplementary safeguard.

The use of hCaptcha is based on Art. 6(1)(f) GDPR — our legitimate interest in protecting our website from misuse and spam. For further information, please refer to the hCaptcha Privacy Policy and the hCaptcha Terms of Service.

(11) Changes to this privacy policy

We may update our Privacy Policy from time to time. We encourage you to review this Privacy Policy periodically. Changes are effective when they are posted on this page.
